Site Terms of Service
This Site Terms of Service Agreement (“Terms”) governs your use of the ClubZella® marketplace platform offered by Baron App, Inc., doing business as ClubZella (“we”, “us”, or “ClubZella”), including our website (clubzella.com), mobile application (“App”), and services we provide through them (collectively, the website, App, and services referred to as our “Site”). “You” refers to you as a user of the Site. These Terms apply to users of, including visitors to, our Site. Use of our Site is also subject to our current Acceptable Use Policy and Community Guidelines. Your use of our Site as a Talent User (defined below) is governed by the Talent Terms of Service. (“Talent Terms”). PLEASE READ THESE TERMS CAREFULLY. By using our Site or otherwise indicating your acceptance (for example, by agreeing when creating or logging into your account, clicking “I Agree,” etc.), you represent and warrant that you have read, understand, and agree to be bound by these Terms. If you do not agree, do not access or use our Site.
Arbitration Notice: Section 6 of these Terms contains provisions governing how claims between you and ClubZella are resolved. It contains an arbitration agreement that will, with limited exceptions, require disputes to be submitted to binding and final arbitration.
1. ClubZella Marketplace
By creating an account on our Site, you agree to provide true, accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and for all activity under your account.
2. Account Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use our Services. If you are using the Site on behalf of an entity, you represent you have authority to bind that entity to these Terms.
3. Acceptable Use
You agree not to misuse the Site. Prohibited activities include fraud, harassment, attempts to gain unauthorized access, and any actions that interfere with the operation or security of the Site.
4. Payments & Refunds
Prices may vary based on currency exchange rates and other factors. Most purchases are final, but in exceptional circumstances we may provide a replacement or refund in line with our policies.
5. Intellectual Property
All content on the Site, including designs, text, graphics, and trademarks, is owned by or licensed to ClubZella. Unauthorized use is prohibited.
6. Dispute Resolution
Any disputes arising from these Terms will be resolved on an individual basis in accordance with applicable laws. If a dispute cannot be resolved informally, it may be submitted to binding alternative dispute resolution where permitted.
